Spond Terms of Use

1. Rights and obligations when using Spond – acceptance of standard terms

These terms govern the use of Spond and related services and functionality, from now on referred to as the “Terms”. 

If you start using Spond, you accept that an agreement is entered into between you and Spond AS (“Spond AS”, “we” or “us”) subject to these Terms.

If you shall create or otherwise administer groups in Spond, please pay extra attention to section 2 below.

Separate terms apply to Spond Club, and the Terms may be supplemented by specific terms applicable to certain services. You can read all our terms here: https://www.spond.com/spond-terms/.

2. Particular terms for group administrators

A group administrator is one who creates a group in Spond or who is otherwise granted permissions to administrate a group. You must be at least 15 years old to be a group administrator.

As a group administrator you have a particular responsibility to:

  • Have consent from those you wish to add as group members or participants in Spond Fundraiser. If persons you add are under 13 years old you need consent from their legal guardians.
  • Get consent from group members if you wish to process their personal data for purposes outside Spond, such as in connection with export of statistics, attendance, etc. 
  • Not publish, encourage or otherwise accommodate for the storing or sharing of sensitive information about your group members or others.

3. Age limit

Even if the age limit for being a group administrator is 15 years, Spond can be used by children under the age of 15 who are registered as users by the group administrator or the child’s guardian. Parts of the service can be subject to other age limits.

4. Changes to the Terms or the service

We may change the Terms. In case of significant changes, we will notify you in an appropriate manner. For other changes, new terms will be published on spond.com. If you continue to use Spond, you are considered to have accepted the new terms.

We continuously develop Spond. This means that we may add, change or remove functionality or parts of the service. We will notify you of significant changes in an appropriate manner.  

5. Your use of Spond

When using Spond you accept that all such use shall take place in accordance with these Terms and that you otherwise shall use the service in accordance with the purpose and intentions of the service. This means, for example, that you shall not:

  • Use Spond in connection with illegal activity, other activity commonly considered undesirable, or in a manner that may negatively affect Spond. In case of doubt or disagreement, we will determine whether an activity or use is undesirable or otherwise negative for Spond. 
  • Publish content or other materials that is, or may be perceived as, inappropriate, indecent, offensive or degrading.
  • Publish content or other materials to which any other person holds proprietary rights, without prior agreement with such rights holder.
  • Copy, publish, resell, modify, interfere, obtain unlawful access to (or attempt to do so) to Spond, its software, user interface or personal information or other content in Spond.
  • Gain access to, copy, publish or in other ways use the personal data of other Spond users for any other purpose than to create, administrate and participate in Spond groups or events.
  • Publish information about others to a greater extent than strictly necessary, and in any case not if there is reason to believe that the individuals concerned may perceive it as problematic or uncomfortable that the information is published.
  • Add participants to Spond groups or events without their prior consent.
  • Try to bypass security-related features in Spond.
  • Share your password with others.

If you use Spond in violation of these principles or the Terms in general, we may suspend or close your user account and terminate the agreement with immediate effect. We may, on our own initiative, monitor and investigate specific or randomly selected content with the intention of uncovering violations of the Terms. We may also remove or censor content or other material that we believe violates these Terms, or the purpose or intentions with Spond.

6. Third party services

Some services accessible through Spond (for example weather services) are provided by other providers than us. Your use of such third party services may be subject to the third party provider’s separate terms and conditions. We may decide to replace or discontinue third party services and accept no liability relating to such services, including without limitation for errors, inaccuracies or unavailability.  

7. Interruption and errors

Spond may from time to time be completely or partially unavailable due to maintenance, updates or other reasons. We will, as far as practicable, provide information about limitations in accessibility of service. In case of errors on Spond or associated services, we will begin rectification as soon as we become aware of the error. We ask that you notify us at [email protected] if you discover any errors. Errors that do not significantly affect functionality may be rectified in conjunction with planned upgrades and similar activities.

There is no cost associated with using Spond. Consequently, no compensation can be claimed if you incur financial loss due to interruptions or errors. However, you may choose to terminate the agreement, see section 9. Neither this provision nor any other provisions in these Terms are intended to limit any rights you may have under mandatory consumer legislation.

8. Content and Copyright

Spond AS owns Spond and has all copyright, trademark and other intellectual property rights to the service and content created by or for Spond AS. You retain all ownership rights to your content. This means that content or other material published by other users is their property and that you may not use such content unless you have an agreement with the owner of such content.

As a user, you are responsible for the content that you publish through Spond.

Content that violates any third party rights will be removed from Spond as soon as possible after we become aware of such content.

9. Termination of the agreement

The agreement between you and Spond AS applies until terminated by either you or Spond AS. You can terminate the agreement by stop using Spond and deleting your user profile. If we wish to terminate the agreement, we will, as far as possible, notify you in advance. See information about how you can delete your account/profile and your personal data in our help center.

10. Personal data

The processing of personal information in connection with Spond is governed by our Privacy Policy.

11. Spond Cashback

What is Spond Cashback? As a user of Spond, you can through Spond Cashback contribute to the Spond group(s) you create or are associated with receiving payments as a result of your purchases with partners who currently have a Cashback agreement with Spond AS.

Transactions included in Spond Cashback. Spond Cashback applies to purchases you make with our Spond Cashback partners. Note that the number and which partners we have agreements with may vary. See the current list of partners on spond.com.

For in-store purchases, only transactions processed through BankAxept, including contactless payments through BankAxept, are included. Payments using credit cards such as VISA, Mastercard, Diners, AMEX, and similar cards are covered when using Spond Cashback online, but not in-store.

Bank account number. To use Spond Cashback, you must provide your bank account number in your Spond profile and select which Spond group(s) should receive the contributions. You should not register an account number belonging to someone else without first obtaining their consent to such registration. In connection with obtaining such consent, you must also inform the account owner about these Terms. Spond verifies that the bank account number you register actually belongs to you through Vipps or Tink (BankID).

Invoicing and payments. We invoice the partner for Spond Cashback and make monthly payments to the group(s) you have designated as the recipient(s) of your contribution. However, payment is made only after Spond AS has received full settlement from the partner. For purchases made in-store, we typically receive settlement within 60 days, calculated from the first day of the following month after a purchase from a partner is completed. Any taxes, fees, and other expenses resulting from Spond Cashback payments are not the responsibility of Spond AS. It is the group administrator for each team or group who enters the bank account number to which we transfer Spond Cashback.

Minimum amount. We will not make any payments until the total amount collected to be paid as Spond Cashback to a group exceeds 500 NOK (“Minimum Amount”). If the earned amount is less than the Minimum Amount, the balance will be carried over to the next month and paid out when the Minimum Amount is reached.

Payment upon deletion of a Spond group. If a group administrator deletes the group and the group has earned Spond Cashback that has not been paid out, the group administrator must contact us within 30 days after the group is deleted to receive the earned Spond Cashback. If the Minimum Amount has not been reached, we will deduct the welcome gift before payment is made.

Payment in case of inactivity. If a group has not earned Spond Cashback in the last 12 months and the earned amount is less than the Minimum Amount, the earned Spond Cashback will be forfeited to Spond AS.

Analysis. Spond AS may use purchase history to analyze trends at partner stores or services. When conducting such analyses, personally identifiable information will not be used.

12. Spond Fundraising campaign**

What is Spond Fundraising Campaign? Spond Fundraising Campaign is a service that allows members, friends, family, and others whom you invite to the fundraising campaign to contribute to the finances of the team or group by purchasing services or products where the team or group receives a share of the sale.

Creation of a Spond Fundraising Campaign. It is the administrator of a Spond group who creates the campaign within their group. The administrator is responsible for informing the members that they are creating a fundraising campaign. There are specific terms for creating a Spond Fundraising Campaign, and a separate agreement must be made before the fundraising campaign is created.

Settlement and payment. Spond conducts settlement and distribution of the campaign’s revenues approximately 14 days after the campaign is completed. Payments are made to the group’s bank account as provided by the administrator during registration.

13. Dispute resolution

Any legal dispute that may arise between you and Spond AS is governed by Norwegian law. Any disputes that are not resolved will be settled with Oslo District Court.
